On Thursday, a lawsuit of patent infringement was filed by The Pokemon Company including the Nintendo brand against the Palworld developer company, Pocketpair Inc. Before the game launch, the game was known as Pokemon was Guns. The gameplay is about the survival adventure mechanics of Pokemon using balls and other items in their battles. Pokemon in-game was quite similar to the ones established over the years by the brand.
The lawsuit is titled “Filing a Lawsuit for Infringement of Patent Rights against Pocketpair, Inc”. It was officially posted on their Japanese website. The lawsuit states, “seeks an injunction against infringement and compensation for damages on the grounds that Palworld infringes multiple patent rights”. Moreover, Nintendo mentioned that the franchise will continue to take necessary actions against any infringement of its intellectual patent rights. The statement continues as it is to protect Nintendo and its franchises that have worked hard and took them years to establish.
The statements and lawsuits showcase the damages on the grounds made by the Palworld. The joint lawsuit by Nintendo and the Pokemon Company against Pocketpair is to seek an injunction against infringement and compensation for damages. There is no news or statement from Pocketpair Inc. at this moment. However, Pocketpair mentioned that they haven’t heard anything from the Nintendo. Although the President of Nintendo, Shuntaro Furukawa gave a statement regarding this matter in February. He mentioned, “We will take appropriate action against those that infringe our intellectual property rights”. However, why the legal team of Nintendo waited nine months to file a lawsuit is unknown.
Gamers are confused about the actions from both sides. Nintendo took nine months to file the lawsuit while it was very clear that Pokemon were replicated. On the other side, the CEO of Pocketpair, Takuro Mizobe cites on record that the Palworld has cleared all the legal reviews. Palworld is available to play on PC and Xbox and there are rumors about its showcases at Tokyo Game Show. Fans were expecting a Palworld PlayStation Port and 1.0 release.
